Excerpt from Accusation dated 12/02/2014:

FIRST CAUSE FOR DISCIPLINE
(Violation of Professional Confidence)

8. Respondent is subject to disciplinary action under section 2227 and 2234, as defined by section 2263, of the Code, in that he violated professional confidence, as more particularly alleged hereinafter:

9. Beginning sometime in 1998 and continuing to sometime in July 2013, respondent was employed as a physician and surgeon by Kaiser Permanente Medical Group (KPMG). During that time period, respondent had access to the medical records of all patients treated at KPMG facilities throughout Southern California.

10. On or about sometime beginning January 1, 2012, and continuing to sometime in June 2013, respondent was employed at KPMG's Baldwin Park Medical Center. During that time period, respondent accessed, without authorization or legitimate medical purpose, the medical records of approximately 172 patients. The medical records accessed by respondent were those of KPMG employees and their family members, who respondent had never treated.

11. On or about July 17, 2013, respondent resigned from his employment with KPMG.

12. On or about May 27, 2014, during an interview with a Department of Consumer Affairs (DCA) investigator, respondent admitted that he had accessed the medical records of patients he was not treating and had not treated at anytime in the past.

SECOND CAUSE FOR DISCIPLINE
(General Unprofessional Conduct)

13. Respondent is further subject to disciplinary action under sections 2227 and 2234, of the Code, in that he engaged in conduct which breaches the rules or ethical code of the medical profession, or conduct which is unbecoming to a member in good standing of the medical profession, and which demonstrates an unfitness to practice medicine as more particularly alleged in paragraphs 8 through 12, above, which are hereby incorporated by reference and realleged as if fully set forth herein.

SECTION 822 CAUSE FOR ACTION (Mental Illness)

14. Respondent's Physician's and Surgeon's Certificate No. A 62418 is subject to action under section 822 of the Code in that he suffers from a mental illness that impairs his ability to practice medicine safely, as more particularly alleged hereinafter:

A. On or about July 23, 2013, the Board received information alleging that respondent had accessed a number of medical records of patients to whom he had not provided care or treatment. On or about October August 30, 2013, the Board initiated an investigation of respondent's alleged conduct.

B. On or about May 27, 2014, respondent was asked, and agreed, to voluntarily undergo a psychiatric examination.

C. On or about September 14, 2014, respondent underwent a psychiatric evaluation with M.N., M.D. Dr. M.N. is Board Certified by the American Board of Psychiatry and Neurology in Psychiatry, Forensic Psychiatry, and Behavioral Neurology and Neuropsychiatry. Prior to the examination, Dr. M.N. reviewed respondent's statements to the DCA investigator and respondent's medical records from K.W., M.F.T.; R.S., M.D.; D.F., Ph.D.; A.A., M.D.; and R.M., M.D. In addition, Dr. M.N. obtained a complete history from respondent and conducted a mental status examination, and psychological testing of respondent.

E. Based on his examination, Dr. M.N. concluded, in pertinent part: "[Respondent] has mental illness that affects his ability to engage in the practice of medicine... [Respondent]'s mental illness led him to express his frustrations in an inappropriate manner that was disrespectful and hurtful to individuals who sought care at Kaiser."..."[Respondent] is able to practice safely as long as the following conditions are met: He needs to be under the care of a psychiatrist and psychotherapist in an ongoing manner."
