ISMAEL SILVA, JR., M.D. DR SILVA IS PROHIBITED FROM ANY CONDUCT THAT VIOLATES CALIFORNIA LABOR CODE SECTION 139.3, INCLUDING BUT NOT LIMITED TO 1) REFERRING A PERSON FOR CLINICAL LABORATORY, DIAGNOSTIC NUCLEAR MEDICINE, RADIATION ONCOLOGY, PHYSICAL THERAPY, PHYSICAL REHABILITATION, PSYCHOMETRIC TESTING, HOME INFUSION THERAPY, OUTPATIENT SURGERY, DIAGNOSTIC IMAGING GOODS OR SERVICES OR PHARMACY GOODS, WHETHER FOR TREATMENT OR MEDICAL-LEGAL PURPOSES, IF HE OR HIS IMMEDIATE FAMILY HAS A FINANCIAL INTEREST WITH THE PERSON OR ENTITY RECEIVING THE REFERRAL; 2) ENTERING INTO AN ARRANGEMENT OR SCHEME, SUCH AS A CROSS-REFERRAL ARRANGEMENT; 3) OFFERING, DELIVERING, RECEIVING, OR ACCEPTING ANY REBATE, REFUND, COMMISSION, PREFERENCE, PATRONAGE DIVIDEND, DISCOUNT OR OTHER CONSIDERATION, WHETHER IN THE FORM OF MONEY OR OTHERWISE, AS COMPENSATION OR INDUCEMENT FOR A REFERRED EVALUATION OR CONSULTATION; AND  4) PRESENTING ANY CLAIM FOR PAYMENT TO ANY INDIVIDUAL, THIRD-PARTY PAYOR, OR OTHER ENTITY FOR ANY GOODS OR SERVICES FURNISHED PURSUANT TO A REFERRAL PROHIBITED UNDER THE LAW.

3. On April 3, 2017, Complaint No. l7CF0799, entitled People of the State of California v. Ismael Silva Jr.; was filed in the Superior Court of California, County of Orange, by Tony Rackauckas, Orange County District Attorney, through Deputy District Attorney Shaddi Kamiabipour.

4. Complaint No. 17CF0799 charges Defendant with ten felony counts of health care fraud, including felony counts of unlawful client or patient referral (also as capping) in violation of business and Professions Code section 650: felony counts of illegal referral of clients for compensation in violation of Labor Code section 321 S; making false and fraudulent claims in violation of Penal Code section 549, and conspiracy to commit insurance fraud, a felony, in violation of Penal Code section 550, subdivision (a)(6).

This website came about when it was discovered that the Medical Board of California's website was very flawed and missing a startling amount of Public disciplinary information. When we tried to work with the board (at the time, Executive Director Kimberly Kirchmeyer and Staff Attorney Kerrie Webb), they chose to not participate and made it very difficult to get the public information we were requesting, which they still do to this day. It was due to their inaction and beligerance that this website was created. Anyone having a problem with this website's existence or the information it contains, should direct their criticism to the Medical Board of California by clicking their names to send an email to them.

DISCLAIMER: Most of the information found on this website is hand-culled directly from the Medical Board of California's ("Board") website and from news articles and is only as good as that original information; it's just easier to find and read here. We have a VERY small team of advocates working on this project, and cannot keep everything up to date in real time. Always check the Medical Board website directly for more information or changes.

**The California Medical Association (CMA) is a union of sorts for doctors in California. They have a lot of political power and donate a lot of money to the state's legislators in return for their "support." They appear to have a lot of "sway" over the Medical Board's members. One would think that most doctors would be members of the CMA with the amount of power they wield, but in actuality, 2/3 of this state's doctors refuse to join the CMA...which means that the majority of doctors in the state, choose to NOT be members.
