Police: Man passed out in drive-thru arrested for DUI

The Aiken Department of Public Safety arrested a man for driving while intoxicated after he was found asleep in his vehicle in a McDonald’s drive-thru.

Mackie Walker Jr., 61, of North Augusta, was charged with driving under the influence and for an open container, according to a police report.

Shortly after midnight on Friday, police responded to call about a man who was unconscious in a drive-thru line at the Richland Avenue McDonald’s. When police arrived, they found a black Infiniti SUV sitting stationary in the drive-thru and the unresponsive driver. Police tried several times to wake the driver up, and after a few minutes, he regained consciousness but was very confused, according to a report. The driver told police that he had not slept since the previous morning.

The driver was asked to pull into a parking spot. He was also asked if he was willing to take a series of tests to determine if he was OK to drive, to which he consented. Police also searched his vehicle and found a coffee mug containing wine, the report read. (LINK) — 07/25/2014

Doctor arrested for DUI and possession of a controlled substance

AIKEN, S.C. – A man is arrested and charged with DUI and possession of a controlled substance, according Aiken Department of Public Safety.

According to the incident report, Dr. Mackie Walker, Jr. was pulled over by a public safety officer after Walker was allegedly weaving in and out of the lane, while traveling east on Richland Avenue. In the incident report, the officer pulled Walker over on Fauberg Street.

When the officer walked over the Walker’s car, the incident report states the officer detected an odor of alcohol. Walker agreed to complete a sobriety test, according to the report.

During the sobriety test, the incident report states, Walker allegedly had trouble standing up, and was swaying back and forth. The report says Walker also allegedly had difficulties balancing and walking in a straight line.

After further tests, Walker was arrested for DUI, according to the incident report. While the officer searched his car, the report states the officer allegedly discovered a bio-hazard bag with eight pills, and two partial pieces of a pill. There was also a pill bottle prescribed by Walker for another person, according to the report.

In the incident report, Walker claims the pills were for male enhancement. The officer also discovered five beer cans on the passenger seat, according to the report.

The incident report states the Aiken Department of Public Safety has submitted warrants for possession of a prescription without a prescription, and possession of a schedule IV substance as well. (LINK) — 08/21/2015

Aiken doctor pleads guilty to federal charges involving illegal distribution of oxycodone

An Aiken podiatrist pleaded guilty to federal charges Wednesday involving the illegal distribution of oxycodone to multiple patients.

Dr. Mackie James Walker Jr., 63, of the 400 block of Lake Murray Drive in North Augusta, pleaded guilty to one count of the indictment which charged “conspiracy to possess with intent to distribute, and to distribute oxycodone, a Schedule II controlled substance,” according to court documents.

According to the indictment, the count states:

• “An agreement between two or more persons to engage in conduct that violates a federal drug law.”

• “(Walker) knowingly and voluntarily participated in the conspiracy.”

• “(Walker’s) actions were not for legitimate medical purposes in the usual course of his professional medical practice or were beyond the bounds of medical practice.”

Walker faces a fine of up to $1 million and/or 20 years in prison, the court documents state.

He remains out on bond and will be sentenced at a later date.

Jack Swerling and Harrison Saunders, both of Columbia, are serving as Walker’s attorneys.

Walker was indicted in January 2016 after it was discovered that he wrote illegal prescriptions for more than 50,000 oxycodone pills, according to court records.

The Drug Enforcement Administration investigated Walker, which led to his indictment.

According to the DEA website, oxycodone is an opioid classified as a Schedule II narcotic, which means it has strict regulations. The drug gives users a feeling of euphoria and can be abused orally or intravenously. Overdose can cause extreme drowsiness, heart slowing, fainting and death.

In 2014, more than 14,000 people died from overdosing on opioids, according to the Centers for Disease Control and Prevention website.

Walker was arrested on Aug. 16, 2015, and charged with driving under the influence of alcohol, possession of prescription drugs without a prescription, and possession of a schedule four controlled substance, according to an incident report provided by the Aiken Department of Public Safety.

Officers reported that upon searching Walker’s car they found a variety of prescription pills in a bag and a cooler with five alcoholic beverage cans on the passenger seat, the report said.

He was taken to the Aiken County detention center and was released on Aug. 17, 2015, on an $11,229.50 bond, according to court records.

Walker also was charged with driving under the influence and for an open container in July 2014.
